Terms of Service – Argonstack

1. Introduction

Welcome to Argonstack! It is important that you carefully review and understand these Terms of Service before using our platform and services.

By accepting these Terms, creating an account, or using our platform, you agree to be bound by them. If you do not agree, do not accept these Terms, create an account, or use our platform or services.

We may update these Terms from time to time, and we will notify you of any material changes. Continued use of our platform after updates constitutes acceptance of the revised Terms.

These Terms include important legal provisions, such as warranty disclaimers, liability limitations, and a mandatory arbitration clause. You should consult a lawyer if you have questions about your rights and obligations under these Terms.

2. Agreement to Terms

These Terms, along with our Privacy Policy, Data Processing Agreement (DPA), and Affiliate Agreement (collectively, the “Terms”), constitute a legally binding contract between You (or the business entity You represent) and Argonstack Inc., including its officers, directors, business affiliates, successors, and assigns (“Argonstack,” “we,” or “us”).

2.1. Legally Binding Agreement

The numbered clauses in this document form the legally binding contract between You and Argonstack. Any explanatory text in italics is for informational purposes only and is not legally binding.

If You accept these Terms on behalf of a business entity, You represent that You have the legal authority to bind that entity to these Terms.

3. Eligibility & Account Ownership

3.1. Age Restrictions

📌 You must be at least 18 years old to use the platform.

By using the platform, You confirm that You are at least 18 years old. If You are a parent or legal guardian permitting a minor (ages 13-17) to use the platform, You:

  • Accept full responsibility for their use of the platform.
  • Acknowledge that You are legally bound by these Terms on their behalf.

3.2. Account Registration & Ownership

📌 You must provide accurate and complete information when registering for an Argonstack account.

  • If You register as an individual, You own the account.
  • If You register on behalf of a business entity, the business entity owns the account.

You are responsible for maintaining the confidentiality of Your login credentials and all activity under Your account. If You suspect unauthorized access, notify Argonstack immediately.

4. Authorized Use of the Platform

4.1. Intended Use

📌 The platform may only be used for lawful purposes.

You agree that You and Your customers will not:

✅ Use the platform in violation of any laws or regulations.
✅ Engage in any Prohibited Uses as defined by Argonstack.
✅ Misrepresent Argonstack’s services.
✅ Allow unauthorized individuals to access the platform under Your account.

You are responsible for ensuring that Your employees, agents, and customers comply with these Terms.

4.2. Privacy & Data Protection

By using the platform, You agree to Argonstack’s Privacy Policy, 

📌 Data Ownership & Access:

  • You and Your customers retain full ownership of all data stored on the platform.
  • Argonstack does not access, use, or process customer data unless explicitly requested for technical support purposes.
  • Administrators have technical access to customer data (e.g., contacts, messages, and leads), but they are contractually prohibited from viewing or using this data unless a support request requires it.

📌 Your Responsibility:

  • You must implement and enforce Your own Privacy Policy for Your customers.
  • You must obtain consent from Your customers before sharing their data with Argonstack.

4.3. Communications & Messaging Services

If You use the platform’s communication features (SMS, MMS, email, or voice calls), You:

✅ Are solely responsible for compliance with applicable laws, such as the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.
✅ Agree that Argonstack does not send communications on Your behalf—You control all messaging content and delivery.
✅ Release Argonstack from any liability related to message compliance, fraud prevention, or call blocking.

4.4. Third-Party Services

Argonstack integrates with third-party services, but:

📌 We do not control third-party services and are not responsible for their availability.
📌 If You pause or delete Your account, some features (such as phone numbers or email services) may not be recoverable.

4.5. Platform Updates & Modifications

📌 Argonstack reserves the right to update or modify the platform at any time.

You agree that:

✅ Updates may impact how the platform operates.
✅ Your use of the platform is not contingent on the continued availability of any specific feature.

5. Termination & Account Suspension

5.1. Termination by Argonstack

📌 We may suspend or terminate Your access without notice if You:

❌ Violate these Terms.
❌ Engage in illegal, fraudulent, or harmful activity.
❌ Fail to comply with applicable laws or regulations.

5.2. User Termination Rights

You may delete Your account at any time, but:

📌 No refunds will be issued for prior payments.
📌 Certain data may be retained for legal compliance purposes.

6. Limitation of Liability

📌 The platform is provided “AS IS” and “AS AVAILABLE”, with no guarantees regarding performance, reliability, or uptime.

Argonstack is not liable for:

❌ Business losses or lost profits.
❌ Data loss due to service interruptions.
❌ Errors, bugs, or malfunctions.

📌 Total liability shall not exceed the amount paid by You for the service or $100, whichever is lower.

📌 Some jurisdictions do not allow certain warranty exclusions, so parts of this clause may not apply to You.

7. Governing Law & Dispute Resolution

📌 These Terms are governed by the laws of Greece.

📌 In case of disputes, You agree to attempt informal resolution first by contacting Argonstack.

If informal resolution is unsuccessful, disputes shall be resolved through arbitration in Athens, Greece.

8. Changes to These Terms

📌 Argonstack reserves the right to modify these Terms at any time.

  • If changes are material, we will notify You at least 30 days in advance.
  • If You continue using the platform after updates, You accept the new Terms.
